Privacy Policy
  • Whimmed is committed to protecting the privacy and accuracy of your confidential information to the extent possible, subject to provisions of state and federal law. Other than as required by law, personally-identifiable information is not actively shared. In particular, we do not re-distribute or sell personal information collected on our web servers. Your personal information may be shared with our service providers only for the purpose for meeting technical requirements for providing our services. (For example, if you send us an email, our email application provider will also, by necessity, be collecting your personal information for the purpose of transmitting your message. We do not sell your information to them and further maintain relationships built on confidentiality and strict privacy agreements.)
  • This Privacy Notice applies to our privacy practices related to the use of our website. In the event of any conflicts between this Privacy Notice and a separate agreement between you and us, the terms of the separate agreement shall apply to the extent permitted by law.
Information collected
  • Whimmed may collect personal information such as name, address, e-mail address, telephone number(s), and/or educational interests. Such personal information is collected by us in order to provide our services to you. Additional personal information, such as credit card account information, may be requested for purchases or enrollment purposes.
  • We use your Personal Information only for the purpose for which it was obtained and keep it only as long as necessary. We do not sell your Personal Information to third parties. We do not use your Personal Information for purposes unrelated to marketing and providing our business products and services.
  • Web servers typically collect, at least temporarily, the following information: Internet Protocol (IP) address of computer being used; web pages requested; referring web page; browser used; date and time. Whimmed may collect statistics identifying particular IP addresses from which our websites are accessed. As with your other personal information, we do not sell your IP address information.
Use of collected information
  • Whimmed may use personal information collected from our websites or through correspondence with you for the purpose of future communication, but only after you have agreed to receive communications from us regarding our services, but only if you are provided the opportunity to opt out of that type of use.
  • Some Whimmed online activity sites may use “cookies” in order to deliver web content specific to individual users’ interests or to keep track of online purchasing transactions. Sensitive personal information is not stored within cookies.
  • Exceptions to this privacy policy for the purpose of providing agreed services within a contractual relationship will be specifically and mutually agreed upon via a separate document and agreement.
Distribution of collected information
  • Whimmed will not disclose, without your consent, personal information collected about you, except for certain explicit circumstances in which disclosure is required by law.
  • Whimmed will not distribute or sell personal information to third-party organizations. Exceptions to this for the purpose of providing services will be agreed upon in individualized service agreements which take precedence over this privacy policy. Any specific rights and responsibilities not mentioned by separate agreement that are addressed by this agreement remain applicable under this agreement.
Responsibility for external sites
  • Whimmed does not control the content or information practices of external organizations. We recommend you review the privacy statements of these organizations.
General Data Protection Regulation (GDPR)
  • If you are accessing this site from a country that is a member of the European Union (EU), the European Economic Area (EAA), or the United Kingdom (UK), the processing of your Personal Data is subject to the General Data Protection Regulation (GDPR), the UK GDPR, or other European Privacy laws. Whimmed complies with the requirements of GDPR, the UK GDPR, and other European privacy laws. Please note: at this time, Whimmed limits their client relationships to those who are within the United States of America and to those contractual client agreements governed by laws of the United States of America.
Your Rights Related to Your Personal Information
  • You have basic privacy and data protection rights related to the data we process about you. Please submit queries and requests regarding your rights to privacy@whimmed.com. We are happy to adjust our handling of your information in order to better meet your needs. We will not discriminate against you if you choose to exercise your rights. We will honor the requests you make related to your rights when we are required to by law or when doing so will not prevent us from exercising our legal rights.  In the case there are legal or other official reasons that we may not be able to address your specific request related to your rights, you have the right to:
    1. Request access to any of your personal information that we process;
    2. Request that we correct any incomplete or inaccurate personal information about you;
    3. Request deletion of your personal information from our databases;
    4. Request restrictions, temporarily or permanently, on our processing of some or all personal information about you;
    5. Opt-out or object to our use of personal information about you where either:
      1. Our use is based on your consent or our legitimate interests, or
      2. You do not want us to share with third parties data related to cookies and similar technologies for website functionality or advertising purposes.
  • We may request personal information from you to verify your identity when you exercise one of the aforementioned rights.
Personal Information Related to Minors
  • Our website is not intended for children under 13 years of age.  We do not knowingly collect the personal information from children under 13.  If you are under age 13, please do not provide any information on this website.
Who We Share Personal Information With
  • We work with credible third parties to deliver, support and market our services such as data storage, delivering messages, processing credit card payments, analyzing data, providing marketing assistance, security monitoring, communication with users, and video playback platforms.  We do not share your personal information with non-agent third parties, we do not sell your personal information.  These third party service providers only have access to personal information based on an executed contract that limits their access to and use of personal information to very specific, legally authorized and ethically permitted tasks.  In addition to the privacy commitments we make to users, these service providers have their own legal obligations to maintain the privacy of your personal information.We may also personal data is shared with unlisted third parties for the purposes of delivering services, marketing, security, product development and process improvement.  We may also share personal information with law enforcement, government agencies and parties to legal proceedings, but only when we have received a lawful request for personal information that cannot be declined.
How Long We Keep Your Personal Information 
  • How long we keep your personal information depends on how you use and interact with our website and services.  We retain some account information for as long as your account is active and a reasonable period after your account is no longer active. Certain account information contained in activity logs and error alerts will be purged even while accounts are active. We also retain your personal information as necessary to comply with our legal obligations, to resolve disputes, to enforce our agreements, and to continue to develop and improve our services. We retain information used for marketing purposes for as long as you elect to continue receiving marketing information from us.We may also retain personal information to comply with legal, contractual, technical, operational, and information security requirements.

  • We do everything reasonably practical to set privacy standards to the most restrictive possible while also giving you the opportunity to opt out of communication from us when possible.
